It's on the seller to deliver the promised goods. Considering the first shipment was, intentionally or not, a bait and switch - it's not your responsibility to resolve it. I recommend getting a refund from ebay. If you want to be especially nice to the guy, send photos of the envelope, etc but it isn't your responsibility to prove anything here.

I'm sure his next step will be to demand that you return the tokens you were sent - don't do anything on that front until ebay resolves everything and issues you a full refund. Ask ebay after you request a refund as to what you should do with the incomplete package that was sent to you.

Even though the seller isn't looking good so far in this interaction, I think the best approach is still to try to work out a resolution with the Seller (perhaps a partial refund to account for the missing tokens, or return of the tokens for a full refund). If a satisfactory resolution isn't worked out with the seller within a few days, then you can pursue a refund via eBay or PayPal (or your credit card company if you paid via credit card), and you can show that you made a good faith effort to resolve it with the seller before going to them.

Just when you thought this thread was dead!

The replacements sell by the seller got lost in the mail. Not the envelope, the tokens! I contacted the seller, he did the post office insurance claim, and a couple days ago, gave me a refund.

Of $30. When I contacted him saying it wasn’t enough, his reply was that’s he’s been patient but this is getting out of hand.

I reached out one more time, saying that PayPal can resolve it for us. I was trying to avoid that, as this whole thing is my word against his. I am telling the truth, but he doesn’t know me, and I don’t know him. I want to believe this is a series of unfortunate events for both of us.

PayPal doesn’t know us; who will they believe?

Hopefully this will get resolved one way or another. I guess I should have returned the tokens day one and moved on with my life...

Open a eBay claim first. Open an “item not as described” claim. You will win. Just state the facts. Auction said items in picture, did not receive them. And that is it. Don’t even mention a partial refund or tokens lost in mail unless asked by eBay. Just say seller won’t provide full refund or replacements.

Let me restate you will win. eBay heavily favors the buyer. If you lose eBay case open PayPal case. You still have more options if both those fail.

We tried telling you to open a case at the beginning. I’m not sure how many days it has been for an eBay claim but PayPal claims are quite generous in duration since purchase.

I am not reading this entire 9 page posting. So, if I'm wrong about something I'm about to say that's why.

This entire posting centers around a very questionable eBay auction. After knowing this and having people throw in their $0.02 someone bid and won it and now may have gotten ripped off... YA THINK?!?

The seller may have just been stringing this along for time all along. I believe it is 60 days from date of sale so you might be out of time. Even if is past the time, contact ebay to dispute anyway and share the concern that it was intentionally set to go past the timetable.

It is also fair to post the seller’s name now to prevent more fraud to the TD community. You went the extra mile but this guy is clearly trying to rip you off.
