They're random, from a pokestop. Not sure if gym spins can spawn them--I haven't heard one way or the other.

You can only have 5 unsent gifts in your backpack--kind of like how you can't get any more eggs if you have nine already. I don't know if there is a limit on the number of unopened gifts that friends have sent you.

Have you looked it up in the TDb ?
