In the legal sense, yes, it is gambling, because you are risking whatever you paid for the cost of the ticket.<br />If the cost of the ticket is a 'donation' though, and you are not required to buy a ticket to win, then it is technically not gambling.  (But then anyone who asks for a free ticket must be allowed to have one.)

Am I correct that it's considered gambling when using anything that has monetary value for betting? That's sort of a slippery definition isn't it? Anything other than actual money could have absolutely no value or all the value in the world depending on what its worth to someone else. I could wager with dog poo unless someone decided they would be willing to pay for it?<br /><br /><br /><br />

Well, in a world where dog poo has a value, it would be considered gambling.  Good luck finding that world.  Blech.<br /><br />Since gold has an intrinsic value (even if just in the worlds of TD & eBay) it could still be considered gambling.  If they want to do a raffle, I'm sure Jeff would check with Gen Con on the rules for that.  But like I said, if someone could get a raffle ticket for free just by asking for one, it'd probably be OK.  And then anyone who wants extra tickets could give a 'donation' to TD for them.<br /><br /><br /><br />Also, these laws tend to vary a little by state and county.

Well, I guess my point is, you could probably find people somewhere who could find some value in almost anything. You should see some of the odd things that sell on ebay. Now, I'll grant you dog poo is an extreme example, and I know of no groups that have decided its good for clayworking or something, but I think you see where I'm coming from. You can assign monetary value to almost anything so long as you can find more than one person in the world who values it and would be willing to pay money for it.<br /><br />Because of this rather ludicrious loophole in such a law, I find it highly unlikely that the law would come crashing down on any sort of game of chance (of which poker is only partially but that's another arguement) unless it was using items of obvious and widespread value: cash, checks, money orders, precious stones, precious metals, real property, cars, etc. or items that have high recognition as impliments of gambling, such as poker chips, if it can be proven that intent was there to exchange those chips at some point for the items of monetary value aforementioned.<br /><br />I haven't read the exact verbiage of the law of course but...<br /><br /><br />

I have been arguing in favor of a poker game for tokens.  I have been told repeatedly by people in the forums that tokens are considered "items of value" because they can be sold so using them as poker chips is gambling.  If that rule applys to poker then it should apply to a lottery.  <br /><br />If as Jammies suggests the only way to make the lottery not gambling is to allow people to request a free lottery ticket, then why would anyone buy a ticket.
